These Terms of Service ("Terms") govern your access to and use of www.jetwindpower.com and any related content, tools, and services we make available through it (collectively, the "Site"), operated by JetWind Power Corporation ("JetWind," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not access or use the Site.

We may modify these Terms at any time. When we do, we will revise the Effective Date above. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, and able to form a legally binding contract to use the Site. By using the Site, you represent and warrant that you meet these requirements and that any information you provide is accurate and complete. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own informational and commercial evaluation purposes, subject to these Terms. You agree not to:

  • Use the Site in any way that violates any applicable law or regulation;
  • Copy, reproduce, distribute, republish, or create derivative works from any portion of the Site except as expressly permitted;
  • Use any automated means, including robots, scrapers, or data-mining tools, to access or collect data from the Site without our prior written consent;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any connected networks or systems;
  • Introduce any virus, malware, or other harmful code to the Site;
  • Use the Site to transmit unsolicited or unauthorized advertising or solicitations; or
  • Use the Site in any manner that could disable, overburden, damage, or impair it or interfere with any other party's use of it.

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any conduct that we believe violates these Terms or is otherwise harmful to JetWind or others.

3. Intellectual Property

The Site and all of its contents, including text, graphics, logos, images, video, data compilations, software, interactive tools, and the selection and arrangement thereof, are the property of JetWind or its licensors and are protected by United States and international intellectual property laws. The JetWind name, the JetWind logo, and all related names, logos, product and service names, designs, and slogans are trademarks of JetWind or its affiliates. You may not use any such marks without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in the Site or its contents other than the limited license expressly stated. All rights not expressly granted are reserved by JetWind.

4. Performance Estimates, Projections, and Calculator Tools

The Site may include interactive tools, including an energy output calculator, as well as performance figures, energy production estimates, environmental impact metrics, projected savings, and other forward-looking information regarding JetWind technology and deployments. All such outputs, figures, and projections are provided for general informational and illustrative purposes only.

You acknowledge and agree that:

  • Any energy output, power generation, environmental impact, cost, or savings figures presented on the Site, including any results produced by the energy calculator, are estimates based on assumptions, modeled inputs, and reference data, and do not constitute a guarantee, warranty, or promise of actual results;
  • Actual performance of any JetWind system depends on numerous site-specific factors, including but not limited to location, environmental and operating conditions, equipment configuration, installation, maintenance, and external variables beyond our control, and will vary;
  • The calculator and any projections are not engineering studies, professional advice, or binding offers, and should not be relied upon as the sole basis for any purchasing, financial, investment, or business decision; and
  • Any binding performance commitments, specifications, or pricing will be set forth solely in a separate written agreement executed between JetWind and the applicable party, and those documents, not the Site, will govern.

To the fullest extent permitted by law, JetWind disclaims all liability arising from your reliance on any estimate, projection, or calculator output presented on the Site.

5. No Professional Advice

The content on the Site is provided for general informational purposes only and does not constitute engineering, financial, investment, legal, regulatory, or other professional advice. You should consult qualified professionals before making any decision based on information found on the Site.

6. Forward-Looking Statements

The Site may contain forward-looking statements regarding JetWind's plans, projects, expectations, and future performance. These statements reflect our current views and are subject to risks and uncertainties that could cause actual results to differ materially. We undertake no obligation to update any forward-looking statement except as required by law.

7. Submissions and Communications

If you submit information, inquiries, ideas, or other materials to us through the Site, you grant JetWind a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and act upon those materials for the purpose of responding to you and operating our business, except to the extent the materials contain personal information, which we handle in accordance with our Privacy Policy. You are responsible for the accuracy of any information you submit.

8. Third-Party Links and Content

The Site may contain links to third-party websites, services, and content, including embedded video and social media, that we do not own or control. We provide these links and embeds for convenience only and do not endorse and are not responsible for the content, products, services, or practices of any third party. Your use of any third-party site or service is governed by that party's own terms and policies, and is at your own risk.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, TOOLS, AND MATERIALS ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, JETWIND DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. JETWIND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT, INCLUDING ANY ESTIMATE OR CALCULATOR OUTPUT, IS ACCURATE, COMPLETE, OR RELIABLE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL JETWIND OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ANY CONTENT ON IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF JETWIND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, JETWIND'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless JetWind and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You agree that any action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction and venue of those courts.

13. Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

14. Entire Agreement

These Terms, together with the Privacy Policy and any other notices or agreements posted on the Site, constitute the entire agreement between you and JetWind regarding your use of the Site and supersede any prior agreements on that subject. These Terms do not govern the sale, deployment, or provision of JetWind products or services, which are governed by separate written agreements.
